What is a trademark?
A trademark can be a sign of all kinds, in particular words, including personal names, or images, letters, numbers, colors, the shape or packaging of the goods or sounds, insofar as such signs are capable of distinguishing the goods or services of one company from those of other companies and to be presented clearly and unambiguously. The trademark can only be reliably protected by registering a trademark with the trademark office. No protection is guaranteed without registration or only through use.
Why do I need a trademark?
With a trademark registration, its owner acquires an exclusive right to use his trademark for specific goods or services in the specific country. He can exclude anyone else from using his trademark.
How much to register a trademark?
As an example the official trademark fees for the Swiss IGE are 550 CHF for 10 year but due to specific circumstances the price can increase. In Switzerland 3 nice classes are included but some offices only include 1 nice class. Prices can be different, if you register a trademark in the EU you need a EU domicile address, for some offices you have to translate in the local language (Czech) or in english. Litigation can result in significantly higher costs if, for example, a mark in a Nice class has not been used for more than 5 years. A layman can make mistakes in complex trademark law. Many brand lawyers only work on the basis of the higher hourly rates and not according to the lawyer's remuneration law. You cannot go wrong with our package variants with advice.

How long does a trademark registration take?
A trademark registration can be done quickly. We normally use the digital or so called "fast process" which can be finished in 2 or 3 months. In most cases you have protection from the day of registration if the mark is successfully registered. Proper preparation is important. If, for example, an objection is raised to the registration, the trademark can be removed from the so-called fast track procedure and it can take months to register. Appropriate checks can help to solve many problems in advance.
Why is it important to trademark your brand?
A trademark application or an entry in the official trademark register can increase the value of your brand and the company. A registered trademark offers protection and reputation, because the registration of the trademark grants its owner an exclusive right of use. Third parties can be prohibited from using the brand. What are different types of trademarks that can be protected?
The most common are the wordmark and figurative mark (logo or design). A wordmark consists exclusively of words or letters, numbers, other typographic symbols. Figurative marks (logos or designs) are marks in which non-standardized characters, stylizations, or layouts or color are used. This also includes brands that consist exclusively of image elements. Wordmarks and picture elements are combined for image marks with word elements, such as the BMW logo with a blue-white circle or the red CocaCola lettering. There is also the (three-dimensional) shape mark, position mark, sample mark, audio mark, color mark, movement mark, multimedia mark (with a combination of image and sound), and the hologram mark.
How long will my trademark be protected?
The protection of the trademark lasts 10 years from the registration date and can be extended for 10 years at a time. IMPORTANT: If the holder has not used the trademark for the goods or services for which it is registered within 5 years of registration, the trademark can be declared invalid if requested. The use must take place in the respective Nice class or service.
